Terms of Use

These terms and conditions (hereinafter referred to as "these Terms") apply to the purchase transactions of products and services (collectively referred to as "the Services") provided by SUN MOON CO., LTD. (hereinafter referred to as "the Company") through the online shop "Inzen Hinata" (https://inzen-hinata.jp) (hereinafter referred to as "the Website"), which is operated by the Company. These Terms govern the sale of products manufactured by the Company or by the manufacturer’s brand, as well as the related services provided to customers by the Company.


Article 1 (Membership)

1. "Member" refers to an individual who applies for membership in accordance with the procedure set by the Company and agrees to these Terms.
2. "Member Information" refers to information about the member’s attributes and transaction history provided by the member to the Company.
3. These Terms apply to all members and are the rules that must be followed during registration and after registration.

Article 2 (Registration)

1. Membership
An individual who agrees to these Terms and completes the required registration procedure will have membership eligibility after completing the registration process. The registration procedure must be done by the individual wishing to become a member. Registration by proxy is not allowed. In addition, applications for membership from individuals whose membership has been previously canceled or those deemed inappropriate by the Company may be rejected.

2. Entering Member Information
During the registration process, please carefully read the input guidelines and accurately fill in the required fields in the registration form. Special characters, old kanji, and Roman numerals cannot be used for member information. If these are entered, the Company will make necessary corrections.

3. Password Management
(1) The password can only be used by the registered member and may not be transferred or lent to third parties.
(2) The member must manage the password responsibly, ensuring it is changed periodically and kept confidential.
(3) Any actions taken using the password will be regarded as the member’s actions, and all resulting payments and responsibilities will be borne by the member.

Article 3 (Changes)

1. If there are any changes to the information the member has provided, such as name or address, the member must promptly notify the Company.
2. The Company is not responsible for any damages resulting from a failure to update information. Even if changes are made, transactions that have already been processed will follow the information registered before the change.

Article 4 (Cancellation)

If a member wishes to cancel their membership, the member must complete the cancellation procedure themselves. Membership will be terminated after the prescribed cancellation procedure is completed.

Article 5 (Loss of Membership and Compensation Liability)

1. If a member makes false declarations during registration, neglects payment duties, or has other reasons deemed inappropriate by the Company, the Company can cancel the member’s membership.

2. The member will be responsible for compensating any damages caused by the following actions:
(1) Unauthorized use of membership number or password
(2) Interfering with the Company’s business or sending harmful programs
(3) Infringing on the intellectual property rights of the Company’s products
(4) Engaging in other actions that violate these Terms

Article 6 (Handling of Member Information)

1. The Company will not disclose member information to third parties without prior consent, except in the following cases:
(1) If required by law
(2) If the Company deems disclosure necessary to protect its rights, interests, or reputation

2. Member information will be managed by the Company in accordance with its "Personal Information Protection Policy." It will be used for purposes such as providing services, improving services, promoting use, and ensuring smooth service operation.

3. The Company may send newsletters or other information (including advertisements) to members. If a member does not wish to receive such information, they can notify the Company as per the prescribed method. However, information necessary for the operation of services cannot be stopped at the member’s request.

Article 7 (Prohibited Activities)

Members are prohibited from engaging in the following actions:

1. Violating laws or these Terms and conditions
2. Damaging the rights, interests, or reputation of the Company or third parties
3. Engaging in actions that could harm the physical or mental health of minors or violate public order and morals
4. Causing inconvenience or discomfort to other users or third parties
5. Entering false information
6. Sending or posting harmful computer programs or emails
7. Unauthorized access to the Company’s servers or computers
8. Lending, transferring, or sharing passwords with third parties
9. Other actions deemed inappropriate by the Company

Article 8 (Service Suspension, Interruption, etc.)

1. The Company may suspend the provision of all or part of the Services without prior notice if any of the following occurs:
(1) Necessary system maintenance or emergency maintenance
(2) Overload on the system
(3) System issues caused by fire, power outages, or third-party interference
(4) Any other circumstances where the Company deems suspension necessary

Article 9 (Service Changes or Discontinuation)

The Company may, at its discretion, change or discontinue all or part of the Services without prior notice.

Article 10 (Disclaimer)

1. The Company is not responsible for damages caused by system interruptions, delays, data loss, unauthorized data access, or other issues related to the Services.
2. The Company does not guarantee that emails or content sent from its website, servers, or domains are free of harmful computer viruses.
3. The Company is not responsible for damages caused by violations of these Terms by the member.

Article 11 (Amendment of These Terms)

The Company may revise these Terms at its discretion and may also establish supplementary terms. Any changes to these Terms or supplementary terms will take effect when posted on the Company’s designated site. Members are required to comply with the revised or supplementary terms.

Article 12 (Governing Law and Jurisdiction)

In the event of a dispute related to these Terms, the competent district court having jurisdiction over the location of the Company’s head office will be the exclusive court of first instance.
